The USCIS premium processing fee increased to $2,805 for Form I-129 requesting E-1, E-2, E-3, H-1B, H-3, L (including blanket L-1), O, P, Q, or TN nonimmigrant classification, and for Form I-140 requesting EB-1, EB-2, or EB-3 immigrant visa classification. Additionally, other visa types have also experienced fee updates.

Premium processing allows petitioners to request expedited processing of certain employment-based immigration benefit requests. Specifically, it enables petitioners to request 15-day processing of their case. If USCIS does not take certain adjudicative action within the 15 calendar days, USCIS refunds the premium processing service fee and continues with expedited processing of the petition.

USCIS considers a petitioner to have made a proper request for premium processing when the petitioner submits the current version of Form I-907, Request for Premium Processing Service, with the correct fee. USCIS must receive the Form I-907 and the associated petition, Form I-129 or Form I-140, Immigrant Petition for Alien Workers, concurrently. USCIS will reject a Form I-907 requesting premium processing that is filed without an associated Form I-129 or Form I-140.
